Immediate Roadside Sanctions

Immediate Roadside Sanctions in Alberta

Receiving an Immediate Roadside Sanction (IRS) is one of the most serious and costly outcomes you can face as a driver in Alberta. Unlike a standard traffic ticket, an IRS takes effect immediately. Your licence is suspended immediately, your vehicle can be seized, and the financial consequences begin piling up before you even make it home. If this has happened to you, do not wait. The window to challenge an IRS is short, and the decisions you make in the first 7 days are critical.

What Is an Immediate Roadside Sanction?

An Immediate Roadside Sanction is an administrative penalty issued under the Traffic Safety Act when a peace officer determines that a driver has a blood alcohol concentration (BAC) registering in the warn range (0.05 to 0.079) or fail range (0.08 or higher) on a roadside screening device. An IRS can also be issued if a driver refuses to comply with a sobriety test or drug evaluation. These sanctions are separate from any criminal charges that may also be laid under the Criminal Code of Canada, meaning you can face both at the same time.

Because an IRS is an administrative process rather than a criminal one, many drivers assume they have no recourse. That assumption is expensive. You absolutely have the right to challenge the IRS, and that is exactly what our team is here to help you do.

The Real Cost of an Immediate Roadside Sanction

The financial and personal impact of an IRS is significant, and it compounds quickly. Here is what you are looking at:

First Occurrence (Warn Range)

  • Immediate 3-day licence suspension
  • 3-day vehicle seizure with towing and storage fees
  • $300 fine
  • $150 administrative penalty fee
  • Potential insurance rate increases

First Occurrence (Fail Range or Refusal)

  • Immediate 90-day licence suspension
  • 30-day vehicle seizure with towing and storage fees
  • $1,200 fine plus surcharges
  • Mandatory enrollment in the Ignition Interlock Program
  • Substantially higher insurance premiums

For a second or subsequent occurrence, the penalties escalate further. Licence suspensions become longer, fines increase, and the Ignition Interlock requirement extends. When you add up the fines, towing, storage, administrative fees, ignition interlock costs, and insurance increases, the total cost of an IRS can easily reach several thousand dollars. That does not include the impact on your livelihood if driving is part of your job.

You Have 7 Days to Act

You Have 7 Days to Act

Under the Traffic Safety Act, you have 7 days from the date of the sanction to submit a written request for an Administrative Review with the Registrar of Motor Vehicles (SafeRoads Alberta). Missing this deadline means losing your right to challenge the IRS entirely.

There are specific grounds on which a review can succeed. These include issues with the approved screening device, procedural errors by the officer at the roadside, improper handling of the testing process, and factual disputes about what actually occurred. These are not simple arguments to make on your own, and the review process has strict requirements. Having an experienced representative in your corner makes a real difference.
